Terms of Service

Welcome to Kysana. These Terms of Service ("Terms") govern your access to and use of the Kysana platform, including our website, applications, and services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform. Kysana GmbH ("Kysana", "we", "us", or "our") operates the Platform from Switzerland.

Kysana is a nutrition management platform that:

• Connects clients with qualified nutritionists for personalized dietary advice.
• Enables nutritionists to create and manage meal plans, track client progress, and manage their practice.
• Provides tools for health data tracking, dietary analysis, and nutritional goal setting.
• Facilitates secure communication between clients and nutritionists.

Kysana does not provide medical advice. The Platform is a tool for nutritional guidance and should not replace professional medical consultation.

To use the Platform, you must:

• Be at least 16 years of age.
• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. Kysana reserves the right to suspend or terminate accounts that violate these Terms.

By using the Platform, you acknowledge that Kysana processes health-related data as described in our Privacy Policy. You consent to:

• The collection and processing of health data you voluntarily provide.
• Sharing your health data with your assigned nutritionist.
• The storage of health data in accordance with our data retention policy.

You may withdraw consent for health data processing at any time by contacting us, though this may limit the services available to you.

Nutritionists using the Platform agree to:

• Provide accurate professional credentials and maintain valid certifications.
• Deliver nutritional advice in accordance with professional standards and applicable regulations.
• Maintain client confidentiality and comply with data protection requirements.
• Not provide medical diagnoses or prescribe medication through the Platform.
• Comply with all applicable laws and professional codes of conduct.

Kysana reserves the right to verify credentials and suspend accounts of nutritionists who fail to meet professional standards.

Certain features of the Platform require a paid subscription. By subscribing, you agree to:

• Pay the applicable fees as described at the time of purchase.
• Provide accurate billing information.
• Automatic renewal of subscriptions unless cancelled before the renewal date.

Refunds are handled in accordance with Swiss consumer protection law. You may cancel your subscription at any time; access continues until the end of the current billing period.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Upload false, misleading, or harmful content.
• Attempt to gain unauthorized access to other accounts or Platform systems.
• Interfere with or disrupt the Platform's operation.
• Use automated tools to scrape, crawl, or extract data from the Platform.
• Impersonate any person or misrepresent your affiliation with any entity.
• Share your account credentials with third parties.

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, software, and design — are the property of Kysana GmbH and are protected by Swiss and international intellectual property laws.

Content you create on the Platform (such as meal plans, notes, and messages) remains your intellectual property. By using the Platform, you grant Kysana a limited license to store, display, and process your content solely for the purpose of providing the services.

You may terminate your account at any time by contacting us or using the account settings. Kysana may suspend or terminate your access if:

• You violate these Terms or applicable laws.
• Your account poses a security risk to the Platform or other users.
• We are required to do so by law.
• We discontinue the Platform or relevant services.

Upon termination, your right to use the Platform ceases immediately. Data retention after termination is governed by our Privacy Policy.

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Kysana does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Nutritional advice provided through the Platform is the responsibility of the individual nutritionist, not Kysana.

To the maximum extent permitted by Swiss law, Kysana shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Kysana in the 12 months preceding the claim.

These Terms are governed by the laws of Switzerland. Any disputes arising from or relating to these Terms or the Platform shall be submitted to the exclusive jurisdiction of the courts of Switzerland. Before initiating legal proceedings, you agree to attempt to resolve disputes through good-faith negotiation.

We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Platform or sending you an email at least 30 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the modified Terms.
